Terms & Conditions

These Terms and Conditions govern your use of the website and services provided by Stone Cold Services, LLC (“Stone Cold Services,” “we,” “us,” or “our”). By visiting our site, booking service, accepting a quote, or paying an invoice, you agree to these Terms.

1) Services

We provide residential and light commercial HVAC and refrigeration services in Southwest Florida. Work scope is defined on your estimate or invoice. Any changes require written approval and may result in a change order.

2) Estimates and Pricing

  • Estimates are free unless noted and are valid for 30 days.

  • Prices may change if site conditions differ from information provided or if additional repairs are required for safe operation.

  • Promotions and coupons must be presented before work begins and cannot be combined unless stated.

3) Booking, Access, and Safety

  • Online booking is offered through Housecall Pro. Appointment times are arrival windows, not exact start times.

  • You must provide safe, timely access to the work area, equipment, electrical panels, and water shutoffs. Secure pets and remove fragile items.

  • We may refuse or pause work if conditions are unsafe, including suspected code violations, biological hazards, or aggressive animals.

 

4) Payments

  • Unless otherwise stated, payment is due on completion of service. Deposits may be required for special orders or new system installs.

  • We accept payments through Housecall Pro and its integrated processors. We do not store full card numbers.

  • Late balances may accrue interest at the maximum rate allowed by Florida law and may incur collection costs and reasonable attorney fees.

  • Returned payments may incur a service fee. We reserve lien rights for unpaid balances under Florida law.

 

5) Cancellations and Rescheduling

  • Please give at least 24 hours notice to cancel or reschedule.

  • Missed appointments or late cancellations may be subject to a reasonable trip or diagnostic fee shown on the invoice.

 

6) Parts, Equipment, and Returns

  • New parts and equipment come from licensed distributors or manufacturers.

  • Special order items are not returnable unless the supplier accepts the return and restocking fees are paid.

  • We do not warranty customer supplied parts or equipment and may decline installation of such items.

 

7) Warranties

  • Labor on repairs: 90 days from service date unless noted on the invoice.

  • Labor on new system installations: 1 year from installation date unless the contract specifies otherwise.

  • Parts and equipment: Covered by the manufacturer warranty. Registration and proof of maintenance may be required.

  • No warranty applies if recommended repairs are declined, if equipment is misused or altered, if maintenance is neglected, or if damage is caused by factors outside our control such as power quality issues, flooding, or pests.

  • Drain lines can clog over time. Unless a float switch or shutoff device is installed and operational, we are not responsible for water damage from future clogs.

 

8) Code, Permits, and Refrigerant

  • We perform work to applicable codes and accepted industry standards.

  • Permits and inspections are the homeowner or property owner’s responsibility unless our proposal states that we will obtain them.

  • Refrigerant handling complies with EPA Section 608 requirements. We may require leak repair before recharging systems.

 

9) Photos, Video, and Documentation

We may document equipment and work areas with photos or video for diagnostics, quality assurance, training, and record keeping. These materials may be stored in Housecall Pro. We will not share identifiable photos of your home for marketing without your consent.

 

10) Communications and SMS

By providing your phone number or email, you consent to receive calls, emails, and texts about your appointments, quotes, and service updates. Message and data rates may apply. Reply STOP to opt out of marketing texts. Transactional messages about active jobs may still be sent where allowed.

 

11) User Responsibilities

You represent that you are the owner or have authority to request service at the property. You are responsible for removing personal items from work areas and for the condition of existing ductwork, electrical circuits, drain lines, roofing penetrations, and structural components not installed by us.

 

12) Website Use

All content on our website, including logos, text, and images, is owned by Stone Cold Services or our licensors and is protected by law.

You may not copy, modify, or redistribute site content without permission.

Third party links, map embeds, and review widgets are provided for convenience. We are not responsible for third party sites or their practices.

 

13) Housecall Pro and Other Third Parties

We use Housecall Pro to manage scheduling, customer records, estimates, invoices, and payments. Your use of these features may be subject to the terms and privacy policies of Housecall Pro and its payment partners. See our Privacy Policy for details.

 

14) Disclaimers

Services are provided using reasonable skill and care. Except for express warranties stated in these Terms or in a written contract, we disclaim all other warranties to the fullest extent permitted by law, including implied warranties of merchantability and fitness for a particular purpose.

 

15) Limitation of Liability

To the fullest extent permitted by law, our total liability for any claim arising out of or related to our services is limited to the amount you paid for the specific service that gave rise to the claim or 100 dollars, whichever is greater. We are not liable for indirect, incidental, special, or consequential damages, including lost profits or loss of use.

16) Indemnification

You agree to defend, indemnify, and hold Stone Cold Services and our employees and subcontractors harmless from claims, damages, and expenses arising from your breach of these Terms or misuse of our services, except to the extent caused by our negligence or willful misconduct.

17) Force Majeure

We are not responsible for delays or failure to perform due to events beyond our reasonable control, including severe weather, supply chain disruptions, labor issues, or utility outages.

 

18) Governing Law and Venue

These Terms are governed by the laws of the State of Florida without regard to conflict of laws rules. The exclusive venue for any dispute shall be the state or federal courts located in Florida. You consent to personal jurisdiction in those courts.

19) Changes to These Terms

We may update these Terms from time to time. Updated terms will be posted on this page with a new effective date. Continued use of our website or services after changes are posted means you accept the new Terms.
